Inspection of Cooling and Heating Systems with Boilers (gaseous, liquid, solid fuel) - Temporary Cross-Border Provision of Services

Natural persons, who are Member State citizens and are authorised inspectors of AC-systems and/or heating systems with boilers in another Member State can temporarily and occasionally perform inspections of air-conditioning and/or heating systems with boilers in the Republic of Cyprus in the territory of the Republic of Cyprus once they notify, of their intentions in advance, the Energy Service of the Ministry of Energy, Commerce and Industry .

The inspection of air-conditioning systems includes:

  • Air-conditioning systems of an effective rated output of more than 12KW and air-conditioning systems of buildings that their effective rated output is more than 50KW in total.

The inspection of heating systems with boilers includes:

  • Heating systems with boilers (gaseous, liquid, solid fuels) of an effective rated output, for space heating purposes, of more than 20KW.

“Boiler” means the combined boiler, body-burner unit, designed to transmit to fluids the heat released from burning.

“Air-conditioning system” means a combination of components required to provide a form of indoor air treatment by which temperature is controlled or can be lowered.

The inspection of air-conditioning systems and heating systems with boilers aims to reduce the energy consumption and to limit the carbon dioxide emissions.

The Energy Service, interprets in each individual case the meaning of providing services on a temporary and occasional basis, based on the duration, frequency, periodical nature and continuity and, for control purposes, maintains a list of inspectors who provide services.

Criteria for Inspectors of Air-Conditioning systems and Inspectors of Heating systems with boilers:

The eligibility criteria apply only to natural persons who:

  • are established in another Member State,
  • exercise their profession legally in the Member State of establishment,
  • move to the Republic of Cyprus to provide their services temporarily and occasionally and proportionately with those (services) legally provided in the Member State of establishment,
  • the temporary and occasional base of the services provided is set, and must not exceed, the number of five (5) inspections within a year.

Based on the criteria stated above, a natural person can provide services in the territory of the Republic of Cyprus, without the obligation to register in any registry and without the obligation to obtain any permission. All the criteria stated above should be satisfied according to the relevant Regulations for the inspection of Air-Conditioning systems, which were published as Regulatory Administrative Act No.62/2017 in Appendix III (I) in the Official Gazette of the Republic of Cyprus No.5000, dated 24/2/2017 and/or the relevant Regulations for the inspection of heating systems with boilers which were published as Regulatory Administrative Act No.63/2017 in Appendix III(I) of the Official Gazette of the Republic of Cyprus No.5000, dated 24/2/2017.

Interested parties must notify the Competent Authority (Energy Service) in writing prior to the commencement of the provision of any services, stating that they legally exercise the profession in the Member State of establishment.

The inspectors of Air-Conditioning Systems and the inspectors of Heating Systems with Boilers are obliged to:

  • perform inspections of Air-Conditioning Systems and inspection of Heating Systems with Boilers according to procedures specified in any Ministerial Decree issued according to Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems;
  • fill out the report for inspection of air-conditioning systems and the report for inspection of heating systems with boilers which contains the results of the inspection conducted, suggest recommendations for the cost-effective improvement of the inspected heating and air-conditioning system and fill out any other forms specified in any ministerial decree published according the Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems;
  • submit the report of inspection of air-conditioning systems and the report of inspection of heating systems with boilers to the owner of the building;
  • inform the competent authority, at least one week ahead of time, about the place and time of each inspection the authorised inspector is about to carry out;
  • notify the competent authority, upon request, about the reports of inspections of heating systems and/or the reports of inspection of air-conditioning systems that he/she has conducted, as well as a full list of inspections have been conducted;
  • maintain the provisions of the law concerning The Health and Safety in the Workplace.

The competent authority can suspend or terminate the enrollment of an inspector of heating systems in the registry of inspectors of heating systems with boilers and the enrollment of an inspector of air-conditioning systems in the registry of inspectors of air-conditioning systems when the inspector:

  • fails to comply with any provision of the Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems;
  • systematically fails to perform an inspection and write a report for an inspection of air-conditioning systems or reports for inspection of heating systems with boilers;
  • commits an offence or helps or motivates the committing of an offence in violation of the provisions of the Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems.
