Electrical Services’ Business (Physical & Legal Person)

Operating a Business Engaged in Providing Electrical Services by Physical or Legal Person

General Information

In order to operate a business engaged in providing electrical services in the Republic of Cyprus, one needs to obtain a licence for the operation of a business by the Electrical & Mechanical Services (EMS), which is a department of the Ministry of Transport, Communications and Works.

The electrical services provided by the business include services related to the design, construction of electrical installations, and maintenance of appliances and equipment.

The EMS grants a licence for the operation of a business engaged in providing electrical services, to physical persons and legal entities provided that the following criteria are met:

  • the natural person or legal entity is legally registered at the appropriate authority of its origin country;
  • the employee responsible for all the electrical activities to be undertaken by the business, is registered at the EMS, as an Electrical Engineer or Senior Electrical Technician Engineer or Electrical Installations Contractor or Maintenance Technician of electrical equipment and appliances, according to the electrical works that are to be undertaken by the company;
  • the personnel employed to deal with the electrical activities in Cyprus, shall have knowledge of the Greek language necessary for practicing the profession.

The application for the issuance of the licence for the operation of a business engaged in electrical services can be submitted either through the PSC Cyprus or you can contact directly the competent authority:

  1. The application must be accompanied by the following documents:

    • copy of the Certificate of Incorporation (for legal entities) issued by the Registrar of Companies and Official Receiver or the appropriate authority of the state within which the company is registered (in case the certificate is not available in Greek or English Language, a certified translation in either language needs to be submitted);
    • certificate of registration as self-employed (for natural persons) from the Social Insurance Services or equivalent certificate from the competent authority of the Member State which the person is registered as self-employed;
    • copy of the confirmation of the responsible electrical engineer/Senior Electrical Technician Engineer/ Electrical Installations Contractor/ Maintenance Technician of electrical equipment and appliances that he/she is in the business’ regular service as well as a copy of the confirmation of the business that employs the specific electrical engineer/ Senior Electrical Technician Engineer/ Electrical Installations Contractor /Maintenance Technician of electrical equipment and appliances (in case the confirmations are not available in Greek or English Language, a certified translation in either language needs to be submitted);
    • copy of a valid certificate of registration of the responsible Electrical Engineer/ Senior Electrical Technician Engineer/ Electrical Installations Contractor/ Maintenance Technician of electrical equipment and appliances in the company, issued by the EMS;
    • copy of identity card or passport of the responsible registered Electrical Engineer/ Senior Electrical Technician Engineer/ Electrical Installations Contractor/ Maintenance Technician of electrical equipment and appliances and the rest of the personnel to be employed in Cyprus (in case the document is not available in Greek or English language, a certified translation in either language needs to be submitted);
    • Fee of € 46.00 (either by cash, cheque or bank transfer).

The applicant is informed regarding the authorisation decision within three months from the date that the application form and supporting documents were duly submitted.

The licence for the operation of a business engaged in electrical services is valid for one year; the renewal fee is €46.00.

Administrative Action Against a Competent Authority’s Decision

Any person may file an Administrative Action at the Administrative court against a decision, act or omission of any competent authority or body.

Pursuant to Article 146 of the Constitution, an Administrative Action may be lodged within 75 days from the date of the decision or act or omission or from the day when such decision or act or omission was notified to the applicant.

The Administrative Court acts as a cassation Court and not as a substantive Court. In other words, the Administrative Court may:
I. Dismiss the Administrative Action
II. Annul wholly or partially the contested decision or act
III. Compel the relevant authority or body to take a certain action

After a decision is annulled, the authority and/or public body must reverse things back to the state prior to when the concerned decision and/or act was executed and reexamine.

Appeal Information

An Appeal may be filed against the Administrative Court’s first-instance decision within a period of 42 days from the date such a decision was given.

At the Supreme Court (Court of Appeal Section) hearing, the contested issue of the appeal remains the legality of the decision or act already adjudicated. However, such a revision of the legality of the decision or act is solely examined on the matters and the extent that the two parties have limited the reasons in the relevant notice of appeal.

The decision adopted by the Supreme Court is considered final in relation to the matter that has been judged.

The registered competent person, responsible for the operation of a business engaged in providing electrical services is obliged to comply with the provisions of the Electricity Law and Regulations, as periodically amended.

The registered company is authorised to provide electrical services in accordance with the authorisation granted to the registered Electrical Engineer/ Senior Electrical Technician Engineer/ Electrical Installations Contractor/ Maintenance Technician of electrical equipment and appliances, who is responsible of the electrical activities to be undertaken by the legal entity.

The EMS has the jurisdiction either under any violation of the Law and regulations or under any court’s decision to suspend for such a period as it may deem necessary or revoke the certificate of competency of any Electrical Engineer, Senior Electrical Technician Engineer, Electrical Installations Contractor or Maintenance Technician of electrical equipment and appliances issued. No person, whose certificate of competency has been suspended or revoked, shall, during the period of such suspension or revocation, undertake the responsibility or execution of any electrical installation and/or maintenance of electrical equipment and appliances.
