Weighbridge Operation (Public)

The Controller of Weights and Measures grants a license to register a weighbridge as a public weighbridge only in cases where:

• The interested applicant is an owner of a weighbridge. The term includes any authorized representative, manager supervisor or even tenant of a particular weighbridge who must submit all relevant information and give details for the public weighbridge intended to be registered;
• The weighbridge has a verification certificate and also is labeled, in order to prove that it fulfills all the providences of the relative Weights and Measures Regulations.

The application for registering a weighbridge as a public weighbridge (form TYPE ΙΓ), can be submitted either through the PSC Cyprus or you can contact directly the competent authority:

1. There are is no requirement for accompanying certificates to be submitted with the application.

Upon approval, the applicant needs to pay the following fees to the Ministry of Energy, Commerce and Industry:

• €100,00 for issuing the registration certificate of a public weighbridge (cash or bank transfer).

Administrative Action Against a Competent Authority’s Decision

Any person may file an Administrative Action at the Administrative court against a decision, act or omission of any competent authority or body.

Pursuant to Article 146 of the Constitution, an Administrative Action may be lodged within 75 days from the date of the decision or act or omission or from the day when such decision or act or omission was notified to the applicant.

The Administrative Court acts as a cassation Court and not as a substantive Court. In other words, the Administrative Court may:
I. Dismiss the Administrative Action
II. Annul wholly or partially the contested decision or act
III. Compel the relevant authority or body to take a certain action

After a decision is annulled, the authority and/or public body must reverse things back to the state prior to when the concerned decision and/or act was executed and reexamine.

Appeal Information

An Appeal may be filed against the Administrative Court’s first-instance decision within a period of 42 days from the date such decision was given.

At the Supreme Court (Court of Appeal Section) hearing, the contested issue of the appeal remains the legality of the decision or act already adjudicated for. However, such revision of the legality of the decision or act is solely examined on the matters and the extent that the two parties have limited the reasons in the relevant notice of appeal.

The decision adopted by the Supreme Court is considered final in relation to the matter that has been judged.

In cases where the Certificate of registration of public weighbridge is been cancelled by the Controller of Weights and Measures, the public usage of the weighbridge is simultaneously terminated and the owner must remove the sign hanging on the wall, indicating the registered public weighbridge and its number.

The owner of a weighbridge has the responsibility to:

• Use and operate the public weighbridge according to the relevant Law of Weights and Measures;
• Print out the weight tickets (in three copies) in special form Type IE as defined in the relevant Weights and Measures Regulations;
• Deliver to the recipient of weighing service a copy of the above weight ticket;
• Maintain the initial of every weight ticket issued, bound in a book for at least one year, counting from the issue date of each weight ticket;
• Ensure that the weighbridge has a verification certificate and is labeled, in order to prove that it fulfills the providences of the relative Weights and Measures Regulations;
• Permanently hang up a sign “Registered Public Weighbridge No…” in a prominent position, written in letters of 100 millimetres (at least).

Moreover, in cases where a weighbridge does not have a verification certificate, on-the-spot inspections are conducted aiming to verify and label the weighbridge and also assess whether it fulfills the provisions of the relative Weights and Measures Regulations. The inspections are carried out by Weights and Measures Inspectors.
