Inspection of Air Conditioning and Heating Systems

General Information

In order for a physical person who is a citizen of a Member State of the European Union, to have the ability to perform inspections of air-conditioning and heating systems with boilers in the Republic of Cyprus, according to the law which regulates the Energy Efficiency of Buildings, a Certificate of Competency must be obtained as issued by the Energy Service of the Ministry of Energy, Commerce, and Industry.

The inspection of air-conditioning systems includes:

  • Air-conditioning systems of an effective rated output of more than 12KW and air-conditioning systems of buildings that their effective rated output is more than 50KW in total.

The inspection of heating systems with boilers includes:

  • Heating systems with boilers (gaseous, liquid, solid fuels) of an effective rated output, for space heating purposes, of more than 20KW.

“Boiler” means the combined boiler, body-burner unit, designed to transmit to fluids the heat released from burning.

“Air-conditioning system” means a combination of components required to provide a form of indoor air treatment by which temperature is controlled or can be lowered.

The inspection of air-conditioning systems and heating systems with boilers aims to reduce energy consumption and to limit carbon dioxide emissions.

(A) Criteria for Inspectors of Air-Conditioning systems:

  • The eligibility criteria for becoming an Authorized Inspector for Air-Conditioning Systems apply only to natural persons who:
    • are registered members at the Cyprus Scientific & Technical Chamber (ETEK) in the field of Mechanical Engineering or in the Registry of Engineering Services Providers in case of an EU Member State citizen established in a Member State different than the Republic of Cyprus, according to the Cyprus Scientific & Technical Chamber law;
    • hold a certificate of suitability for Class I – for managing fluorinated gases – as issued by the certification body (the Department of Environment) according to the provisions of the Commission Implementing Regulation (EU) 2015/2067, of the17th of November 2015, “establishing, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of natural persons as regards stationary refrigeration, air conditioning and heat pump equipment, and refrigeration units of refrigerated trucks and trailers, containing fluorinated greenhouse gases and for the certification of companies as regards stationary refrigeration, air conditioning and heat pump equipment, containing fluorinated greenhouse gases”;
    • have three years of professional experience on designing or installing or maintaining air-conditioning systems installed in buildings;
    • hold a seminar attendance certificate regarding health and safety in the workplace, organized by the Energy Service of the Ministry of Energy, Commerce and Industry in collaboration with the Department of Labour.
  • In case of an EU member state citizen, established in a Member State other than the Republic of Cyprus, who exercises the profession lawfully in the Member State (licensed and/or certified in another Member State/s) of establishment and wishes to be established in Cyprus:
    • hold a valid permit or certificate for the inspection of air-conditioning systems granted by another Member State in which the citizen is established.

Any natural person who wants to become an Authorized Inspector of Air-Conditioning Systems should satisfy all the criteria stated above according to the relevant Regulations for the inspection of Air-Conditioning systems, which were published as Regulatory Administrative Act No.62/2017 in Appendix III (I) in the Official Gazette of the Republic of Cyprus No.5000, dated 24/2/2017.

(B) Criteria for Inspectors of Heating systems:

  • The eligibility criteria for becoming an Authorized Inspector for Heating Systems with boilers (gaseous, liquid, solid fuel) apply only to natural persons who:
    • are registered members at the Cyprus Scientific & Technical Chamber (ETEK) in the field of Mechanical Engineering or in the Registry of Engineering Services Providers in case of an EU Member State citizen established in a Member State different than the Republic of Cyprus, according to the Cyprus Scientific & Technical Chamber law;
    • hold a certificate of success in written examination organized either by the Frederick University or the Cyprus Energy Agency (evaluation bodies);
    • have three years of professional experience on designing or installing or maintaining heating system with boilers installed in buildings.
  • In case of an EU member state citizen, established in a Member State other than the Republic of Cyprus, who exercises the profession lawfully in the Member State (licensed and/or certified in another Member State/s) of establishment and wishes to be established in Cyprus:
    • hold a valid permit or certificate for the inspection of heating systems granted by another Member State in which the citizen is established.

Any natural person who wants to become an Authorized Inspector of Heating Systems with boilers should satisfy all the criteria stated above according to the relevant Regulations for the inspection of heating systems with boilers which were published as Regulatory Administrative Act No.63/2017 in Appendix III(I) of the Official Gazette of the Republic of Cyprus No.5000, dated 24/2/2017.

The applcation form for registration as an Inspector of Air-conditioning systems or Heating Systems with boilers can be submitted either through the PSC Cyprus or by contacting directly the competent authority:

    • The application form for registration as an Inspector of Air-conditioning systems should be accompanied by the following documents:
      • copy of certificate of registration as member of the Cyprus Scientific & Technical Chamber in the field of Mechanical Engineering or in the Registry of Engineering Services Providers in case of an EU Member State citizen established in a Member State different than the Republic of Cyprus;
      • copy of certificate of suitability for Class I – for managing fluorinated gases – as issued by the certification body (the Department of Environment);
      • copy/copies of experience certificate/s in which the professional experience (duties, responsibilities, time periods) is documented in studies, contracts, maintenance of air conditioning systems in buildings;
      • seminar attendance certificate regarding health and safety in the workplace organised by the Energy Service of the Ministry of Energy, Commerce and Industry in collaboration with the Department of Labor Inspection;
      • payment receipt of the registration fee of €145 plus VAT for registration in the registry of air conditioning systems inspectors.
    • In case of an EU member state citizen, established in a Member State other than the Republic of Cyprus, who exercises the profession lawfully in the Member State (licensed and/or certified in another Member State/s) of establishment and wishes to be established in Cyprus then the application form for registration as an Inspector of Air-conditioning systems should be accompanied by the following documents:
      • copy of a valid permit or certificate for the inspection of air conditioning systems granted by another Member State in which the citizen is established;
      • payment receipt of the registration fee of €145 plus VAT for registration in the registry of air conditioning systems inspectors.
    • The application form for registration as an Inspector of Heating systems with boiler should be accompanied by the following documents:
      • copy of certificate of registration as member of the Cyprus Scientific & Technical Chamber in the field of Mechanical Engineering or in the Registry of Engineering Services Providers in case of an EU Member State citizen established in a Member State different than the Republic of Cyprus;
      • copy of success certificate in written examination organized either by an evaluation body (the Frederick University or the Cyprus Energy Agency);
      • copy/copies of experience certificate/s in which the professional experience (duties, responsibilities, time periods) is documented in studies, contracts, maintenance of heating systems in buildings;
      • payment receipt of the registration fee of €145 plus VAT for registration in the registry of heating systems inspectors.
    • In case of an EU member state citizen, established in a Member State other than the Republic of Cyprus, who exercises the profession lawfully in the Member State (licensed and/or certified in another Member State/s) of establishment and wishes to be established in Cyprus then the application form for registration as an Inspector of Heating systems should be accompanied by the following documents:
      • copy of a valid permit or certificate for the inspection of heating systems granted by another Member State in which the citizen is established;
      • payment receipt of the registration fee of €145 plus VAT for registration in the registry of heating systems inspectors.

  • Application fee of €145 plus VAT for registration in the registry of air conditioning systems inspectors;
  • Application fee of €145 plus VAT for registration in the registry of heating systems inspectors.

The application fee is payable for registration purposes and it is not refundable in case of non-approval.

The applicant is informed regarding the authorization decision within few days from the date that the application form and supporting documents were duly submitted.

The professional license is valid indefinitely. No renewal fees apply.

Administrative Action Against a Competent Authority’s Decision 

Any person may file an Administrative Action at the Administrative court against a decision, act or omission of any competent authority or body.

Pursuant to Article 146 of the Constitution, an Administrative Action may be lodged within 75 days from the date of the decision or act or omission or from the day when such decision or act or omission was notified to the applicant.

The Administrative Court acts as a cassation Court and not as a substantive Court. In other words, the Administrative Court may:
I. Dismiss the Administrative Action
II. Annul wholly or partially the contested decision or act
III. Compel the relevant authority or body to take a certain action

After a decision is annulled, the authority and/or public body must reverse things back to the state prior to when the concerned decision and/or act was executed and reexamine.

Appeal Information

An Appeal may be filed against the Administrative Court’s first-instance decision within a period of 42 days from the date such a decision was given.

At the Supreme Court (Court of Appeal Section) hearing, the contested issue of the appeal remains the legality of the decision or act already adjudicated. However, such a revision of the legality of the decision or act is solely examined on the matters and the extent that the two parties have limited the reasons in the relevant notice of appeal.

The decision adopted by the Supreme Court is considered final in relation to the matter that has been judged.

The inspectors of Air-Conditioning Systems and the inspectors of Heating Systems with Boilers are obliged to:

  • perform inspections of Air-Conditioning Systems and inspection of Heating Systems with Boilers according to procedures specified in any Ministerial Decree issued according to Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems;
  • fill out the report for inspection of air-conditioning systems and the report for inspection of heating systems with boilers which contains the results of the inspection conducted, suggest recommendations for the cost-effective improvement of the inspected heating and air-conditioning system and fill out any other forms specified in any ministerial decree published according the Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems;
  • submit the report of inspection of air-conditioning systems and the report of inspection of heating systems with boilers to the owner of the building;
  • inform the competent authority, at least one week ahead of time, about the place and time of each inspection the authorized inspector is about to carry out;
  • notify the competent authority, upon request, about the reports of inspections of heating systems and/or the reports of inspection of air-conditioning systems that he/she has conducted, as well as a full list of inspections have been conducted;
  • maintain the provisions of the law concerning The Health and Safety in the Workplace.

The competent authority can suspend or terminate the enrollment of an inspector of heating systems in the registry of inspectors of heating systems with boilers and the enrollment of an inspector of air-conditioning systems in the registry of inspectors of air-conditioning systems when the inspector:

  • fails to comply with any provision of the Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems;
  • systematically fails to perform an inspection and write a report for an inspection of air-conditioning systems or reports for inspection of heating systems with boilers;
  • commits an offence or helps or motivates the committing of an offence in violation of the provisions of the Law that regulates the inspection of heating systems with boilers and the inspection of air-conditioning systems.
